Terms & Conditions

This referral platform (“Platform”) is owned and operated by DebtSafe (Pty) Ltd, a registered Debt Review company operating in accordance with the laws of South Africa with National Credit Regulator number NCRDC1078. By accessing and using the Platform, you agree to be bound by the following terms and conditions (“Terms”).

To be eligible to use the Platform as a Referrer, you must be a legal resident of South Africa, at least 18 years of age, and have legal capacity to enter into agreements. Additionally, Referrers must have a registered bank account and provide proof of residence (FICA) as required by law.

As a Referrer, you may only refer individuals who are over-indebted to DebtSafe for debt review services. Before providing any personal information to DebtSafe, Referrers must obtain explicit consent from the individuals they refer. For each successful referral (a referral who is over-indebted, qualifies for debt review, and signs up for DebtSafe’s debt review program), DebtSafe will pay you a once-off referral fee of R2000 incl. Vat (two thousand rand including VAT).

DebtSafe will only make payments to Referrers who have supplied (uploaded on the platform) DebtSafe with their verified bank details (certified letter from the bank) as well as identification documentation. Referrers are prohibited from misrepresenting the services offered by DebtSafe or making any false claims about the benefits of debt restructuring.

Referrers may only invite personal friends, family members, acquaintances, and colleagues to this Referral Program. They must not use referral methods that are bothersome to the recipients or violate applicable law, including anti-Spam legislation, which prohibits mass distribution of unsolicited messages. Referrers must not publish the Referral Program on any sites or platforms that host Adult Content, Alcohol, Tobacco, Gambling, Games and Online Casinos, Political Content, and any form of illegal activities.

This Program cannot be combined with other DebtSafe’s referral programs, discounts, vouchers, benefits, or incentives. By participating in this Referral Program, we may restrict you from any other promotion, program, discount, or vouchers. Referrers must only use the Referral Program for personal use and refrain from its use for commercial purposes.

Users may only use the Platform for lawful purposes and in accordance with the Terms. This includes refraining from engaging in any fraudulent activities or activities that may harm DebtSafe, its users, or any third party.

All personal information collected and processed as part of DebtSafe’s Referral Platform will be used in accordance with DebtSafe’s Privacy Policy, available at www.debtsafe.co.za/privacy-policy/. Under applicable laws and regulations, DebtSafe shall be responsible for collecting and processing such personal information. Personal information will be collected, processed, and shared with third parties for the following purposes:

• Establishing and verifying the identity of users in accordance with applicable laws.
• Fulfilling DebtSafe’s obligations under the Platform.
• Taking necessary measures to prevent suspicious or fraudulent activity in accordance with applicable laws.
• Reporting to the relevant Regulatory Body, in terms of applicable laws.
• Additional marketing activities: DebtSafe may also share your information with third parties for marketing activities related to DebtSafe’s products and services, subject to your consent. This may include, but is not limited to, sending promotional offers, newsletters, and other marketing communications. You have the right to opt-out of such marketing communications at any time by contacting DebtSafe or following the instructions provided in the communication.

Third parties with whom personal information may be shared for marketing activities have an obligation to keep such information secure and confidential.

DebtSafe uses your Personal Information for the following reasons:

• To establish and verify your identity in terms of applicable laws.
• To enable DebtSafe to fulfill our obligations in terms of this platform.
• To enable DebtSafe to take the necessary measures to prevent any suspicious or fraudulent activity in terms of applicable laws.
• To report to the relevant Regulatory Body, in terms of applicable laws.

DebtSafe may share your information for further processing with the following third parties, which have an obligation to keep your Personal Information secure and confidential: payment processing service providers; law enforcement and fraud prevention agencies; and regulatory authorities and other persons that DebtSafe, in accordance with applicable laws, are required to share your Personal Information with.

These Terms and Conditions were last updated on 03 May 2025. DebtSafe reserves the right to update or modify these Terms and Conditions at any time without prior notice. It is your responsibility to regularly check the Terms and Conditions on the website (https://debtreferral.co.za/) and Debt Referral platform (https://app.debtreferral.co.za/) for any updates or changes.

Continued use of the Platform after any modifications to the Terms and Conditions constitutes your acceptance of such changes.
